1. Service Description
Santa Photo is an AI-powered image editing service that adds Santa Claus, elves, reindeer, or other holiday characters to photos you provide. We use Google Gemini AI technology to generate these images.
2. User Requirements
To use our service, you must:
- Be at least 18 years old or have parental consent
- Provide a valid email address
- Have the legal right to upload any photos you submit
- Agree to these terms and our Privacy Policy
3. Acceptable Use
You agree NOT to use our service to:
- Upload photos you don't have rights to use
- Create deceptive, misleading, or harmful content
- Generate content that infringes on others' rights
- Upload content that is illegal, obscene, or offensive
- Attempt to circumvent our systems or security measures
- Use automated tools to access our service without permission
We reserve the right to refuse service to anyone who violates these terms.
4. Payment and Pricing
Our service costs $5 per photo (or $3 for returning customers within 24 hours). All prices are in USD. Payment is processed securely through Polar.sh. By making a purchase, you agree to pay the stated price.
5. Delivery
After successful payment, your photo will typically be processed within 1-3 minutes. You will receive an email with a download link when your photo is ready. Download links expire after 7 days.

7. Intellectual Property
Your Content
You retain ownership of the photos you upload. By uploading, you grant us a limited license to process your photos solely to provide our service. We do not claim ownership of your photos or the generated images.
Generated Images
You receive full rights to use the generated Santa photos for personal and commercial purposes. This includes printing, sharing on social media, and using for holiday cards.
Our Service
Santa Photo's website, branding, and technology remain our intellectual property.
8. AI-Generated Content Disclaimer
Our service uses AI to generate images. While we strive for high-quality results:
- Results may vary and cannot be guaranteed to match expectations
- AI may occasionally produce unexpected or imperfect results
- Generated images are computer-created and not photographs of real events
9. Limitation of Liability
To the maximum extent permitted by law:
- Our service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the service
10. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of our service or violation of these terms.
11. Service Availability
